NEW HOME LIMITED WARRANTY

1. About This Warranty 1.1 Limited Warranty. This is an express limited warranty (this “Warranty”). Reading this warranty will help you understand our commitment to you and your home. If you have questions about this warranty, please contact us. The contact information for customer service at Century Communities office can be found on our website at www.centurycommunities.com under the Homeowners tab. 1.2 Century Communities – brand names . Century Communities markets its homes under various brand names, such as Jimmy Jacobs, Wade Jurney Homes, and Grand View Builders. Century Communities also has other companies under our Century family of builders that may issue this Warranty. The terms “we,” “our” and “us” and “Century Communities” mean Century Communities (including any brand name we use) or a company under our Century family of builders. 1.3 Types of homes covered . This Warranty covers both detached and attached homes, including, but not limited to, condominiums and townhomes. Section 7 addresses the matters that are applicable only to attached homes. 1.4 FHA/VA – warranty form . If the initial purchase of the home was financed by an FHA or VA loan and that loan is still in effect, this Warranty is not applicable. Please refer to the specific PWC warranty issued with your home. 1.5 State laws - addendum . Included later in this Warranty is a State Addendum that describes certain state laws. You should read the State Addendum, because it supplements this Warranty and should be considered in conjunction with it. Please note that the Federal Arbitration Act (“FAA”) overrides inconsistent state or local laws regarding arbitration. 1.6 Other rights . This Warranty sets forth our written commitment to you regarding the warranty of your home. As a purchaser of a home, however, you may have legal rights in addition to the coverage provided in this Warranty. 1.7 BINDING ARBITRATION . THIS WARRANTY CONTAINS A BINDING ARBITRATION PROVISION IN SECTION 6. IT REQUIRES DISPUTES BE SUBMITTED TO A NEUTRAL THIRD-PARTY ARBITRATOR INSTEAD OF COURT. 2. Builder's Responsibilities 2.1 Definitions . (A) Construction defect. The term “construction defect” as used in this Warranty means a condition that fails to meet a warranty provided in section 2.2 during the applicable warranty coverage period. However, a construction defect does not include conditions that are caused by a condition or circumstance that is excluded from
